This notice sets out how we will use your personal data, and your rights. It is made under Articles 13 and/or 14 of the General Data Protection Regulation (GDPR).
Purpose The purpose for which we are processing your personal data is to establish and manage an online forum for industry to ask questions on trading at the end of the transition period. We will also use the questions and issues raised on the forum to better understand the issues facing traders and to develop support.
We will also use your data to moderate the forum content, and ensure that it is safe and technically secure, and to collect web analytics to help us to monitor usage of the service.
We will also use your data if we need to do so to bring or defend legal proceedings or cooperate with law enforcement.
We will process the following personal data: First name, last name, email address, opinions, and any data you volunteer such as profile information. We also collect your IP address and web analytics data.
Legal basis of processing
The legal basis for processing your web analytics data is your consent (Article 6(1)(a) GDPR).
The legal basis for processing all other personal data is because it is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the data controller (Article 6(1)(e) GDPR). In this case that is to support businesses and traders get ready for new rules coming into place from 1 January 2021.
Sensitive personal data is personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.
We do not collect sensitive personal data, but if you volunteer it our legal basis for processing is that processing is necessary for reasons of substantial public interest for the exercise of a function of the Crown, a Minister of the Crown, or a government department (paragraph 6, schedule 1, Data Protection Act 2018).
Your personal data will be shared by our data processors who provide services under instruction. These are HMRC who provide our web forum, our web hosting supplier, and our own corporate IT suppliers.
Any data you post in the forum or in your profile will be shared with other users of the forum. We may also share your data with other government departments and public bodies if your question needs a response from them.
Your personal data will be kept by us for as long as you wish to remain registered. The forum will be shut down when no longer needed which we anticipate to be in the course of 2021. Where personal data have not been obtained from you Your personal data were obtained by us from a forum member.
You have the right to request information about how your personal data are processed, and to request a copy of that personal data.
You have the right to request that any inaccuracies in your personal data are rectified without delay.
You have the right to request that any incomplete personal data are completed, including by means of a supplementary statement.
You may have the right to request that your personal data are erased if there is no longer a justification for them to be processed.
You have the right in certain circumstances (for example, where accuracy is contested) to request that the processing of your personal data is restricted.
You have the right to object to the processing of your personal data.
For web analytics data:
You have the right to withdraw consent to the processing of your personal data at any time.
You have the right to request a copy of any personal data you have provided, and for this to be provided in a structured, commonly used and machine-readable format.
As your personal data is stored on our IT infrastructure, and shared with our data processors, it may be transferred and stored securely outside the UK. Where that is the case it will be subject to equivalent legal protection through the use of Model Contract Clauses.

If you consider that your personal data has been misused or mishandled, you may make a complaint to the Information Commissioner, who is an independent regulator.
